1. Acceptance of terms
By creating a Nishi account, downloading the Nishi app, or using meetnishi.com (together, the "Service"), you agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you do not agree, do not use the Service.
2. What Nishi is
Nishi is an AI nutrition companion built especially for people on GLP-1 medications. It helps you log food, interpret patterns across your food, wearables, and how you feel, scan menus and receipts, and surface daily observations about your nutrition. The Service is provided by Mirae Ventures LLC ("we," "us," "our"), a United States limited liability company.
Nishi's features evolve. We may add, change, or remove features over time. Material changes that affect what you've paid for will be communicated to you.
3. Health disclaimer
- Not a doctor. Nishi does not diagnose conditions, prescribe medications, manage your GLP-1 prescription, or adjust dosing.
- Not for emergencies. If you are experiencing a medical emergency or believe you may harm yourself, call 911 (or your local emergency number) or go to the nearest emergency room. The Service is not designed for emergency or urgent care.
- Nutrition estimates are estimates. Macronutrients, micronutrients, and calorie values come from public food databases and AI estimation. They are not laboratory measurements and may be inaccurate.
- AI can make mistakes. Observations, suggestions, recipes, and answers are generated by AI systems that can be wrong. Use your judgment, and run anything important by a qualified professional.
- Allergens and dietary restrictions are your responsibility. If you have allergies, intolerances, or medical dietary restrictions, verify ingredients yourself before consuming anything Nishi suggests.
- Talk to your prescriber. Before making significant changes to your nutrition, exercise, or supplement regimen (particularly while on a GLP-1 or other medication), consult the clinician who prescribed it.
- Mental health. If you experience disordered eating or related distress, the Service may not be appropriate for you. Please speak with a qualified mental health professional. 4. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By using Nishi, you represent that you meet this requirement and that the information you provide about yourself is accurate. The Service is not directed to anyone under 13, and we do not knowingly accept users under that age.
5. User accounts
You'll create an account using Sign in with Apple, Sign in with Google, or email. You are responsible for:
- Keeping your credentials and devices secure
- All activity that occurs under your account
- Providing accurate information when you sign up and when you log your food, medications, or how you're feeling
- Notifying us if you suspect unauthorized access
You may delete your account at any time from within the app or by emailing support@meetnishi.com.
6. Subscription terms
Premium plans and pricing
Nishi offers an optional auto-renewable subscription ("Nishi Premium") that unlocks features described in the app and at meetnishi.com/pricing. Current pricing for new subscribers:
- Monthly: $8.99 USD
- Annual: $39.99 USD
Prices are shown in the app and on the website at the time of purchase. Pricing may vary by region and may change. Any change to your existing subscription's renewal price will be communicated to you in advance per Apple's, Google's, or Stripe's policies.
Billing and renewal
- Subscriptions automatically renew at the end of each billing period unless you cancel.
- Your account is charged at the start of each renewal period.
- Payment is processed by Apple, Google, or Stripe depending on where you subscribed.
Cancellation
You can cancel anytime:
- iOS: Settings → Apple ID → Subscriptions → Nishi
- Android: Google Play Store → Subscriptions → Nishi
- Web (Stripe): sign in at meetnishi.com → Account → Manage subscription
Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial subscription periods, except where required by law.
7. Free trial
New subscribers may be eligible for a free trial, typically 7 days. If you do not cancel before the trial ends, you will be automatically charged the subscription fee for the plan you selected.
To help you avoid surprise charges, we send reminders before your trial ends. You can cancel anytime during the trial through the channel where you started it (App Store, Google Play, or your Stripe customer portal). Free trial eligibility is determined by Apple, Google, or Stripe; one trial per user.
8. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose, including in ways that violate health, drug, or consumer protection laws in your jurisdiction
- Attempt to gain unauthorized access to other accounts, the Service, or our systems
- Reverse engineer, decompile, or attempt to extract source code, except where the law expressly permits
- Use the Service to develop a competing product, scrape data, or train machine learning models
- Submit content you don't have the right to submit, including someone else's health information
- Misrepresent your identity, age, or medical status in a way that could harm yourself or others
- Interfere with or disrupt the Service's functionality, security, or other users' experience
We may suspend or terminate accounts that violate these rules.
9. Intellectual property
The Service (including its software, design, content we create, and the Nishi name and logo) is owned by Mirae Ventures LLC and protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use.
You retain ownership of the content you submit (your food logs, your notes, your data). By submitting content, you grant us a license to process and display it as needed to operate the Service for you, and to use it in de-identified and aggregated form to improve the Service. We do not use your content to train third-party AI models or to advertise.
10. Third-party content and services
The Service integrates with third-party services like Apple HealthKit, Google Health Connect, Apple App Store, Google Play, Stripe, OpenAI, Anthropic, and others described in our Privacy Policy. Their terms govern your use of them, and we are not responsible for their content or behavior. The Service may also surface external recipes, articles, or merchant menus that we do not control.
11. Disclaimer of warranties
The service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising out of course of dealing or usage of trade.
Without limiting the foregoing, we make no warranty that the Service will meet your requirements, be uninterrupted, be timely, be secure, or be error-free. We do not warrant the accuracy of nutritional information, the reliability of AI-generated observations or suggestions, the safety of any food or supplement, or any health outcome.
12. Limitation of liability
To the maximum extent permitted by law, in no event will Mirae Ventures LLC, its affiliates, officers, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the service.
Our total liability to you for any claim arising out of or relating to these terms or the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the event giving rise to the claim, or (b) $100 USD.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above may not apply to you. In those jurisdictions, our liability is limited to the smallest amount permitted by law.
13. Indemnification
You agree to defend, indemnify, and hold harmless Mirae Ventures LLC and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your use of the Service in violation of these Terms, your violation of applicable law, or your infringement of any third party's rights.
14. Changes to these terms
We may update these Terms as the Service evolves. When we do, we'll post the updated version here with a new "Last updated" date. For material changes, we'll notify you in the app and by email if you've signed in, before the change takes effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
15. Termination
You may stop using the Service or delete your account at any time. We may suspend or terminate access to the Service for conduct that we reasonably believe violates these Terms or harms other users or the integrity of the Service. Sections that by their nature should survive termination (including Sections 9, 11, 12, 13, and 16) will survive.
16. Disputes and governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. Any dispute arising out of or related to these Terms or the Service will be resolved in the state or federal courts located in Delaware, and you and we consent to personal jurisdiction in those courts. Nothing in this section limits your ability to bring claims in small-claims court where eligible, or to seek injunctive relief in any court of competent jurisdiction.
If any provision of these Terms is held unenforceable, the rest remain in effect.
